The MCS-90 Book: Truckers versus Insurers and the Government
Makes Three, published by the International Risk Management
Institute (IRMI) is the result of a research project of the CPCU
Society's Consulting, Litigation, & Expert Witness (CLEW) Interest Group.
The MCS-90 endorsement is a highly misunderstood and
increasingly litigated one-page insurance endorsement required by the Motor
Carrier Act of 1980 to be attached to policies covering auto liability exposures
of certain types of businesses, such as motor carriers. Its purpose is to
certify that the insured maintains a minimum level of financial responsibility
for compensating others involved in truck accidents that result in bodily
injury, property damage, or environmental damage. The book uncovers many
potential pitfalls, coverage traps, underwriting concerns, and claims issues
lying under the surface of this endorsement. Anyone who buys, sells, or
underwrites insurance for motor carriers or adjusts trucking insurance claims
will benefit from this book.
