Workable Wrap-Ups for Large Construction Projects

Controlled insurance programs (OCIPs and CCIPs), also known as “wrap-ups,” can be effective in controlling cost of risk and securing broad coverage terms for construction projects. A panel of experts will share the best practices to maximize the possibility that an OCIP or CCIP will be successful. Attendees will learn key issues to consider in determining if a CIP is feasible, some of the problems that owners and contractors encounter and how to overcome those issues. They will also discuss the coverage issues contractors must address in their own programs to assure they coordinate with the CIP insurance coverages.

Presenters

Donald S. Malecki, CPCU, is a principal at Malecki Deimling Nielander & Associates L.L.C., based in Erlanger, KY. During his 46-year career, he has worked as a broker, consultant, archivist-historian, teacher, underwriter, and insurance company claims consultant, and as publisher of Malecki on Insurance, a highly regarded monthly newsletter.

William D. Motherway, J.D., is executive vice president with Tishman Realty & Construction Co., Inc. Motherway oversees the corporate-wide risk management program including safety, litigation management, disaster preparedness as well as the administration of the corporate property and casualty programs. He coordinates the marketing and placement of coverages on behalf of clients of the company during construction projects.  Insurance programs include wrap-ups with project premiums in excess of $20 million.

Motherway started Tishman’s captive insurance company, TRIMCO, in 2001 and manages the day-to-day operation of TRIMCO. TRIMCO currently insures the risks of Tishman’s construction, development, hotel and real estate operations.

Motherway was the Risk Manager for the City of New York from 1992 to 1994.  He established citywide contract guidelines to maintain maximum protection for the personnel, property, and assets of the city against risk of loss; developed alternative means of financing and courses of action to the Deputy Mayor for Operations, Office of Management and Budget, Comptroller, Corporation Counsel and all City Agencies.  He also identified property and casualty loss exposures and implemented the most effective combination of risk transfer, risk financing, and loss prevention techniques; and oversaw the city’s workers’ compensation and tort claims administration operation. In addition, he worked with the Comptroller’s Office and the Law Department to develop strategies for the early settlement of claims, alternate dispute resolution and litigation management techniques. He also provided guidance to all levels of city management on risk and insurance matters, while overseeing the citywide Office of Safety and was Chairman of the New York City Local Emergency Planning Committee.

Motherway holds many professional affiliations; is a member of the Florida and New York State Bar, and admitted in the U.S. Southern District of Florida. He graduated from the Miami School of Law, and hold as BS in Biology from Manhattan College.
